Terms and Conditions for MCSAMDAD.COM

Welcome to MCSAMDAD.COM (the “Site”), operated by MCSAMDAD COMMERCIAL LIMITED (“we”, “our”, or “us”). These Terms and Conditions (“Terms”) govern your access to and use of our job board and recruitment services (the “Services”). By accessing or using the Site and Services, you agree to be bound by these Terms, our Privacy Policy, and any other policies or guidelines posted on the Site. If you do not agree to these Terms, you must not use our Services.
Please read these Terms carefully before using the Services.
PART A: GENERAL TERMS APPLICABLE TO ALL USERS
- Definitions
- “User”, “You”, “Your”: Refers to any individual or entity accessing or using the Site or Services, including Job Seekers and Employers.
- “Job Seeker”: An individual actively seeking employment opportunities through the Site.
- “Employer”: An individual or entity posting job vacancies or searching for candidates through the Site.
- “Content”: Includes all information, data, text, software, music, sound, photographs, graphics, video, messages, or other materials posted, uploaded, transmitted, or otherwise made available on the Site by any User.
- “Site”: Refers to mcsamdad.com and any associated mobile applications or platforms.
- “Services”: The job board and recruitment services provided by MCSAMDAD.COM, including but not limited to job posting, resume database access, and job application tools.
- Acceptance of Terms
By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you are using the Services on behalf of an entity, you represent and warrant that you have the authority to bind that entity to these Terms.
- Eligibility
To use the Services, you must be at least 18 years old and capable of forming a binding contract. By using the Services, you represent and warrant that you meet these eligibility requirements.
- Account Registration and Security
- To access certain features of the Services, you may be required to register for an account.
- You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
- You are solely responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
- You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
- We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current, or incomplete.
- User Conduct and Prohibited Activities
You agree not to use the Services for any unlawful purpose or in any way that could harm us or any third party. Prohibited activities include, but are not limited to:
- Posting or transmitting any Content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable.
- Impersonating any person or entity, or falsely stating or otherwise misrepresenting your affiliation with a person or entity.
- Uploading, posting, or otherwise transmitting any Content that you do not have a right to transmit under any law or under contractual or fiduciary relationships.
- Uploading, posting, or otherwise transmitting any unsolicited or unauthorized advertising, promotional materials, “junk mail,” “spam,” “chain letters,” “pyramid schemes,” or any other form of solicitation.
- Uploading, posting, or otherwise transmitting any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy, or limit the functionality of any computer software or hardware or telecommunications equipment.
- Interfering with or disrupting the Services or servers or networks connected to the Services.
- Violating any applicable local, national, or international law or regulation.
- Collecting or storing personal data about other Users without their express consent.
- Scraping, crawling, or using any automated means to access or collect data from the Site.
- Intellectual Property
- All content on the Site, including text, graphics, logos, images, and software, is our property or the property of our licensors and is protected by intellectual property laws.
- You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any of the material on our Site, except as generally permitted through the Site’s functionality.
- By submitting Content to the Site, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such Content in connection with the Services.
- Disclaimers and Limitation of Liability
- “As Is” Basis: The Services are provided on an “as is” and “as available” basis, without any warranties of any kind, express or implied. We do not warrant that the Services will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
- No Guarantee of Employment or Candidates: We do not guarantee that Job Seekers will find employment or that Employers will find suitable candidates through the Services.
- User Content: We are not responsible for the accuracy, completeness, or legality of any Content posted by Users. We do not endorse any opinions expressed by Users.
- Third-Party Links: The Site may contain links to third-party websites. We are not responsible for the content or privacy practices of these websites.
- Limitation of Liability: To the maximum extent permitted by law, we shall not be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Services; (ii) any conduct or content of any third party on the Services; (iii) any content obtained from the Services; and (iv) unauthorized access, use or alteration of your transmissions or content, whether based on warranty, contract,1 tort (including negligence) or any other legal theory, whether or not we have been informed of the possibility of such damage.
- Indemnification
You agree to indemnify, defend, and hold harmless MCSAMDAD COMMERCIAL LIMITED, its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from your use of the Services, your violation of these Terms, or your infringement of any intellectual property or other right of any person or entity.
- Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on the Site and updating the “Effective Date” at the top of these Terms. Your continued use of the Services after such modifications constitutes your acceptance of the revised Terms.
- Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of Ghana, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts located in Accra, Ghana.
- Termination
We may terminate or suspend your access to all or part of the Services immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach these Terms. Upon termination, your right to use the Services will immediately cease.
- Miscellaneous
- Entire Agreement: These Terms, together with our Privacy Policy and any other policies published on the Site, constitute the entire agreement between you and us regarding the Services.
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
- Assignment: You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. We may assign these Terms without restriction.
PART B: TERMS SPECIFIC TO EMPLOYERS
- Employer Account and Job Postings
- By creating an Employer account, you represent and warrant that you are authorized to act on behalf of the company or organization you represent.
- You are solely responsible for the content of your job postings, company profile, and any other information you provide.
- Job postings must be accurate, truthful, and comply with all applicable laws and regulations, including non-discrimination laws.
- You agree not to post jobs that:
- Are discriminatory in nature.
- Require applicants to pay a fee or purchase a product.
- Promote illegal activities or goods.
- Are for multi-level marketing schemes, pyramid schemes, or franchise opportunities that require an upfront investment.
- Are misleading or intentionally vague.
- Are duplicate postings of the same job.
- We reserve the right to remove any job posting that violates these Terms or that we deem inappropriate or harmful to our Users.
- Access to Job Seeker Data
- If you are granted access to our Job Seeker database or receive resumes/CVs, you agree to use this data solely for the purpose of recruiting for legitimate employment opportunities.
- You agree not to:
- Share Job Seeker data with unauthorized third parties.
- Use Job Seeker data for any purpose other than recruitment, including but not limited to marketing, spamming, or data mining.
- Contact Job Seekers for reasons unrelated to a specific job application or legitimate employment opportunity.
- You acknowledge and agree that you are responsible for complying with all applicable data protection laws (e.g., GDPR, local data protection acts) regarding the collection, processing, and storage of Job Seeker personal data.
- Fees and Payments (if applicable)
- If our Services include paid features for Employers (e.g., premium job postings, resume database access), you agree to pay all applicable fees as described on the Site.
- All fees are non-refundable unless otherwise expressly stated.
- We reserve the right to change our fees at any time, but such changes will not apply to services already purchased.
- No Guarantee of Candidates or Hires
While we strive to provide a platform for connecting Employers with Job Seekers, we do not guarantee that you will find suitable candidates or make any hires through the Services.
PART C: TERMS SPECIFIC TO JOB SEEKERS
- Job Seeker Account and Profile
- By creating a Job Seeker account, you agree to provide accurate and truthful information in your profile and resume/CV.
- You are solely responsible for the content of your profile, resume/CV, and any other information you submit.
- You agree not to:
- Submit false or misleading information.
- Impersonate another person.
- Upload any content that infringes on the intellectual property rights of others.
- You understand that Employers may view your profile and resume/CV if you make them searchable or apply for jobs.
- Application Process
- When you apply for a job through the Site, your application, including your resume/CV and any other submitted materials, will be sent directly to the Employer.
- We are not responsible for the Employer’s hiring decisions, interview process, or any actions taken by the Employer.
- We do not guarantee that your application will be viewed, that you will be contacted for an interview, or that you will be hired.
- Data Privacy and Sharing
- By creating a profile and/or applying for jobs, you consent to us sharing your personal data (including your resume/CV) with Employers who may be interested in your profile or for jobs you apply to.
- You understand that once your data is shared with an Employer, its use and storage will be subject to the Employer’s privacy practices, for which we are not responsible.
- You have control over the visibility of your profile and can choose to make it searchable or private.
- No Employment Guarantee
We do not guarantee employment or any specific job offers through the use of our Services. Our role is to provide a platform to connect Job Seekers with potential Employers.
